New York Mart Group Inc. satisfies terms of consent decision and order involving alleged PACA violations

In a complaint filed on Sept. 30, 2019, the USDA alleged that New York Mart Group Inc., Long Island City, N.Y., failed to make full payment promptly in the total amount of $896,107 to 23 sellers for multiple lots of produce in violation of the Perishable Agricultural Commodities Act, or PACA.

After the complaint was filed, USDA and NYMG entered into a consent decision and order wherein NYMG agreed to pay the unpaid produce sellers listed in the appendix A to the complaint and to pay a civil penalty in the amount of $45,000, according to a news release.

As a result of NYMG satisfying the terms of the consent decision and order, the finding that it had committed repeated and flagrant PACA violations was permanently abated without further process and the case has been closed.
