Fresh & Easy LLC satisfied the terms of a consent decision with the U.S. Department of Agriculture regarding its outstanding Perishable Agricultural Commodities Act claims.
The El Segundo, Calif.-based arm of Tesco, which launched on the West Coast in 2007 and filed for bankruptcy in October 2015, allegedly failed to make payment promptly to 23 produce companies for $201,486, according to a USDA administrative action filed Dec. 14.
The payments were for produce sold March 2015 to December 2015.
The consent agreement said Fresh & Easy’s lack of payments was a flagrant and repeated PACA violation, which would have resulted in its PACA license being revoked.
Fresh & Easy has since satisfied the terms of the agreement, and the company remains licensed under PACA.
